Romanian legislation

Codul muncii actualizat 2012 (labor code 2012)

Ore suplimentare:

  • reglementate de Codul Muncii art. 120-123;
  • se acorda a.i. sa nu depaseasca 48 ore pe saptamana ( inclusiv suplimentare), prin exceptie in conditii exceptionale se pot depasi cele 48 h/saptamana cu conditia ca media orelor de munca lucrate pe o perioada de 4 luni sa nu depasesca 48h/saptamana;
  • munca suplimentara se compenseaza cu ore libere platite in urmatoarele 60 de zile calendaristice dupa efectuarea acestora;

Ore lucrate in weekend:

  • reglementate de Codul Muncii art. 137-138;
  • daca se lucreaza in aceste zile atunci salariatii au dreptul la un spor la salariu stabilit prin contractul de munca conf. art. 137, alin 3 ;
  • in cazul in care zilele de repaus saptamanal sunt acordate dupa o perioada de activitate continua de 14 zile ( 2 saptamani non stop) atunci salariatii au dreptul la dublul compensatiilor cuvenite (spor de 100 %) conf art. 137, alin 5;

Ore lucrate in zile libere legale:

  • sunt reglementate de Codul Muncii art. 139-143;
  • daca salariatii lucreaza in aceste zile atunci ei vor beneficia de un spor la salariul de baza ce nu poate fi mai mic de 100% din salariul de baza conf art. 142, alin 2;


Plata orelor suplimentare de catre Navyk

Incepand cu data de 01.11.2012

  • orele suplimentare din timpul saptamanii se vor plati cu spor de 75%
  • orele suplimentare din weekend si sarbatori legale se vor plati cu spor de 100%
