- hours will be considered as overtime after compensation for eventual recover hours
Free time compensation
Per 01-Apr-2016 the free time compensation is as following:
- during the week, hour per hour
- during the weekend and national holidays, double the hours
Payment
Per 01-Nov-2012 the payment of overtime is as following:
- during the week 175%
- during weekend and national holidays 200%
Romanian legislation
Codul Muncii actualizat 2013 (Labour Code 2013)
Ore suplimentare:
- reglementate de Codul Muncii art.111, 117-121
- durata maxima legala a timpului de munca nu poate depasi 48 de ore pe saptamana, inclusiv orele suplimentare;
- prin exceptie, durata timpului de munca, ce include si orele suplimentare, poate fi prelungita peste 48 de ore pe saptamana, cu conditia ca media orelor de munca, calculata pe o perioada de referinta de 3 luni calendaristice, sa nu depaseasca 48 de ore pe saptamana
- munca suplimentara se compenseaza cu ore libere platite in urmatoarele 30 de zile calendaristice dupa efectuarea acestora
Ore lucrate in weekend:
- reglementate de Codul Muncii art.132-133
- daca se lucreaza in aceste zile, atunci salariatii au dreptul la un spor la salariu stabilit prin contractul de munca conform art.132, alin.2
- in cazul in care zilele de repaus saptamanal sunt acordate dupa o perioada de activitate continua de maxim 14 zile calendaristice, atunci salariatii au dreptul la dublul compensatiilor cuvenite (spor de 100%), conform art.132, alin.5
Ore lucrate in zile libere legale:
- sunt reglementate de Codul Muncii art.134-138
- daca salariatii lucreaza in aceste zile atunci ei vor beneficia de un spor la salariul de baza ce nu poate fi mai mic de 100% din salariul de baza, conform art.142, alin 2
Plata orelor suplimentare de catre Navyk
Incepand cu data de 01.11.2012
- orele suplimentare din timpul saptamanii se vor plati cu spor de 75%
- orele suplimentare din weekend si sarbatori legale se vor plati cu spor de 100%
